سؤال: من صلى وهو محدث ناسيا ثم ذكر بعد خروج الوقت هل يلزمه الإعادة؟
الجواب :
من صلى وهو محدث ناسيا ثم ذكر حدثه، سواء ذكره  أثناء الصلاة أو بعد انتهائها أو بعد خروج وقتها فإنه يلزمه إعادتها بلا خلاف بين العلماء لأن الطهارة من الحدث شرط لصحة الصلاة إجماعاً وفي صحيح البخاري ومسلم من حديث أبي هريرة رضي الله عنه قال قال رسول الله صلى الله عليه وسلم: « ﻻ ﻳﻘﺒﻞ اﻟﻠﻪ ﺻﻼﺓ ﺃﺣﺪﻛﻢ ﺇﺫا ﺃﺣﺪﺙ ﺣﺘﻰ ﻳﺘﻮﺿﺄ».
قال شيخ الإسلام ابن تيمية رحمه الله تعالى كما في مجموع الفتاوى 22/99 : ﻭﻛﺬﻟﻚ ﻣﻦ ﻧﺴﻲ ﻃﻬﺎﺭﺓ اﻟﺤﺪﺙ ﻭﺻﻠﻰ ﻧﺎﺳﻴﺎ: ﻓﻌﻠﻴﻪ ﺃﻥ ﻳﻌﻴﺪ اﻟﺼﻼﺓ ﺑﻃﻬﺎﺭﺓ ﺑﻼ ﻧﺰاﻉ ﺣﺘﻰ ﻟﻮ ﻛﺎﻥ اﻟﻨﺎﺳﻲ ﺇﻣﺎﻣﺎ ﻛﺎﻥ ﻋﻠﻴﻪ ﺃﻥ ﻳﻌﻴﺪ اﻟﺼﻼﺓ ﻭﻻ ﺇﻋﺎﺩﺓ ﻋﻠﻰ اﻟﻤﺄﻣﻮﻣﻴﻦ ﺇﺫا ﻟﻢ ﻳﻌﻠﻤﻮا ﻋﻨﺪ ﺟﻤﻬﻮﺭاﻟﻌﻠﻤﺎء ﻛﻤﺎﻟﻚ ﻭاﻟﺸﺎﻓﻌﻲ ﻭﺃﺣﻤﺪ ﻓﻲ اﻟﻤﻨﺼﻮﺹ اﻟﻤﺸﻬﻮﺭ ﻋﻨﻪ. ﻛﻤﺎ ﺟﺮﻯ ﻟﻌﻤﺮ ﻭﻋﺜﻤﺎﻥ- ﺭﺿﻲ اﻟﻠﻪ ﻋﻨﻬﻤﺎ.
ﻭﺃﻣﺎ ﻣﻦ ﻧﺴﻲ ﻃﻬﺎﺭﺓ اﻟﺨﺒﺚ ﻓﺈﻧﻪ ﻻ ﺇﻋﺎﺩﺓ ﻋﻠﻴﻪ ﻓﻲ ﻣﺬﻫﺐ ﻣﺎﻟﻚ ﻭﺃﺣﻤﺪ ﻓﻲ ﺃﺻﺢ اﻟﺮﻭاﻳﺘﻴﻦ ﻋﻨﻪ ﻭاﻟﺸﺎﻓﻌﻲ ﻓﻲ ﺃﺣﺪ ﻗﻮﻟﻴﻪ؛ ﻷﻥ ﻫﺬا ﻣﻦ ﺑﺎﺏ ﻓﻌﻞ اﻟﻤﻨﻬﻲ ﻋﻨﻪ ﻭﺗﻠﻚ ﻣﻦ ﺑﺎﺏ ﺗﺮﻙ اﻟﻤﺄﻣﻮﺭ ﺑﻪ ﻭﻣﻦ ﻓﻌﻞ ﻣﺎ ﻧﻬﻲ ﻋﻨﻪ ﻧﺎﺳﻴﺎ ﻓﻼ ﺇﺛﻢ ﻋﻠﻴﻪ ﺑﺎﻟﻜﺘﺎﺏ ﻭاﻟﺴﻨﺔ. ﻛﻤﺎ ﺟﺎءﺕ ﺑﻪ اﻟﺴﻨﺔ ﻓﻴﻤﻦ ﺃﻛﻞ ﻓﻲ ﺭﻣﻀﺎﻥ ﻧﺎﺳﻴﺎ. ﻭﻫﻮ ﻣﺬﻫﺐ ﺃﺑﻲ ﺣﻨﻴﻔﺔ ﻭاﻟﺸﺎﻓﻌﻲ ﻭﺃﺣﻤﺪ انتهى.
